Terms and Conditions

1. Introduction These Terms and Conditions ("Terms") govern the relationship between Charlotte Avery of NLIVN Travel, LLC ("Travel Agent") and Joy Pemberton and Doug Cosme ("Client"). By booking travel services through the Travel Agent, the Client agrees to be bound by these Terms.

2. Scope of Services The Travel Agent provides services including, but not limited to, travel consultation, itinerary planning, booking of flights, accommodation, car rentals, tours, and other travel-related services. The Travel Agent acts as an intermediary between the Client and travel service providers.

3. Responsibilities of the Travel Agent The Travel Agent agrees to use reasonable efforts to provide accurate information and to make bookings as requested by the Client. The Travel Agent will inform the Client of any changes to their booking as soon as possible. The Travel Agent is not responsible for any errors or omissions in information provided by third-party suppliers.

4. Responsibilities of the Client The Client agrees to provide accurate and complete information to the Travel Agent to facilitate the booking process. The Client is responsible for reviewing all travel documents provided by the Travel Agent and ensuring that all details are correct. The Client is responsible for obtaining and maintaining valid passports, visas, and any other travel documents required for their trip. The Client is responsible for all fees and charges associated with all bookings made through NLIVN Travel, LLC.

5. Payment Terms A non-refundable deposit may be required at the time of booking, depending on the terms of the service providers. The balance of the payment is due as per the schedule provided by the Travel Agent. Payment can be made by credit card, bank transfer, or other methods as agreed upon. Failure to make payments on time may result in the cancellation of the booking.

6. Cancellations and Refunds Cancellations by the Client must be made in writing and are subject to the terms and conditions of the service providers. Cancellation fees may apply, depending on the timing of the cancellation and the policies of the service providers. Refunds, if applicable, will be processed based on the terms of the service providers and may be subject to administrative fees.

7. Changes to Bookings Any changes to bookings requested by the Client may be subject to additional fees and the availability of the desired changes. The Travel Agent will make reasonable efforts to accommodate changes but cannot guarantee that changes will be possible.

8. Travel Insurance The Travel Agent strongly recommends that the Client purchase travel insurance to cover trip cancellations, medical emergencies, lost baggage, and other potential risks. The Travel Agent is not responsible for any losses that could have been covered by insurance.

9. Liability The Travel Agent acts solely as an agent for the Client in arranging travel services and does not own, operate, or control any of the services provided by third-party suppliers. The Travel Agent is not liable for any injury, loss, damage, accident, delay, or irregularity arising from the actions of third-party suppliers. The Client agrees to hold the Travel Agent harmless for any claims arising from the Client’s use of the services booked through the Travel Agent.

10. Indemnification: The Client indemnifies and holds the Agent and its directors, offices, employees, agents, assigns, parents, subsidiaries, and affiliates, harmless from and against any and all claims, demands, actions, suits or proceedings, liabilities, losses, civil penalties, assessments, damages and costs and expenses (including reasonable attorney fees and expert witness fees) asserted by third parties and arising out of any breach by the Client of is representations, warranties and covenants in this Agreement or any act or omission or alleged act or omission on the part of the Client in the performance of, or failure to perform the comply with the obligations contemplated by this Agreement.

11. Force Majeure The Travel Agent is not responsible for any failure or delay in performance due to circumstances beyond its control, including but not limited to an act of God, seizure under local process, sanctions, epidemic, pandemic and/or health alert from the CDC, WHO or a local government in the affected area, quarantine restrictions, fire, fog, volcanic ash, smog, earthquake, flood, weather, hurricane, mechanical difficulties, riots or civil commotions, strikes, labor stoppage (whether resulting from disputes between either party and its employees, or between other parties), war, acts of terrorism, travel service provider disruption or delays, flight cancelations or delays, and any other acts, a matter of things, whether or not of a similar nature.

12. Governing Law These Terms are governed by and construed in accordance with the laws of the state of Maryland, United States of America. Any disputes arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the Seventh Judicial Circuit Court for Prince George's County.

13. Amendments The Travel Agent reserves the right to amend these Terms at any time. Any amendments will be effective immediately upon being posted or communicated to the Client.

14. Acceptance By making a booking and/or signing a group contract with the Travel Agent, the Client acknowledges that they have read, understood, and agree to these Terms and Conditions.
